The Federal High Court sitting in Osogbo has dismissed a suit filed by the Action Peoples Party (APP) seeking the disqualification of the All Progressives Congress (APC) governorship candidate, Asiwaju Munirudeen Bola Oyebamiji (AMBO), from participating in the August 15, 2026, Osun State governorship election.
In its judgment delivered on Wednesday in Suit No. FHC/OS/CS/50/2026 between APP v. Bola Oyebamiji & 2 Others, the court held that the plaintiff lacked the legal standing (locus standi) to institute the action and consequently dismissed the case.
Justice Funmilayo Dame-Ajayi ruled that the suit disclosed no reasonable cause of action and upheld the preliminary objections raised by counsel to the respondents.
The court held that the plaintiff failed to establish that it participated in the primary election conducted by the respondents, a requirement necessary to challenge the nomination of a candidate.
Justice Dame-Ajayi further described the plaintiff as a “meddlesome interloper” in the matter and dismissed the suit for lacking merit.
The court also awarded ₦200,000 costs against the plaintiff.
The APP had approached the court seeking an order disqualifying Oyebamiji from contesting the forthcoming governorship election in Osun State.
Reacting to the judgment, the APC described the ruling as a victory for democracy and the rule of law, saying it had cleared every legal hurdle surrounding the candidacy of its governorship flag bearer.
The party also alleged that the Osun State Government had been using another political platform to institute legal actions against its candidate, citing previous litigation involving the reinstated APC local government chairmen and councillors.
According to the APC, the judgment has affirmed that Oyebamiji remains eligible to contest the August 15 governorship election.
However, the Osun State Government has not officially responded to the APC’s allegation that it sponsored the litigation through the APP.
