APC appeals court verdict on Osun LG chairmen

The All Progressives Congress (APC) in Osun State has described the Federal High Court judgment on the tenure of reinstated local government chairmen and councillors in the state as a miscarriage of justice, vowing to challenge the ruling at the Court of Appeal.

In a statement issued on Monday by the party’s Director of Media and Information, Mogaji Kola Olabisi, the APC said it was dissatisfied with the judgment delivered by the Federal High Court in Osogbo in Suit No. FHC/OS/CS/147/2025, filed by the reinstated council officials elected on October 15, 2022.

According to the party, the suit, instituted in September 2025, was already the subject of pending appeals before the Court of Appeal, Abuja Division, which had adjourned hearing on related interlocutory matters until September 28, 2026.

The APC argued that despite the pending appeals and a motion seeking a stay of proceedings before the appellate court, the trial judge proceeded to deliver judgment, dismissing the suit and ruling that the tenure of the reinstated chairmen and councillors expired in October 2025.

The party noted that the judgment effectively rendered the local government elections conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025, and the subsequent swearing-in of elected officials on February 23, 2025, a nullity, since the court held that the tenure of the plaintiffs subsisted until October 2025.

While accusing the Osun State Government of allegedly spreading misleading interpretations of the ruling, the APC maintained that the reinstated local government officials would continue to perform their duties pending the determination of their appeal.

The party disclosed that it had already filed a notice of appeal and a motion for stay of execution, insisting that no enforcement action could be taken against the affected officials until all legal processes are exhausted.

The APC also urged security agencies to maintain vigilance and prevent any breakdown of law and order, warning against attempts by political actors to exploit the judgment to create tension in the state.

It called on its members and supporters to remain calm and law-abiding while awaiting the final outcome of the appellate process.

“The chairmen and councillors have exercised their constitutional right of appeal. We urge members of the public to exercise restraint and await the final determination of the case,” the statement concluded.
