Osun LGs: Only Supreme Court can sack APC chairmen – Party

The All Progressives Congress, APC,  in Osun State has insisted that only the Supreme Court can invalidate the election of the council chairmen elected in an election conducted by the immediate past Gboyega Oyetola administration.

It warned the ruling Peoples Democratic Party, PDP, to stop misleading the public with its interpretation of the Court of Appeal Judgment of June 13, 2025.

That judgment, it said, did not invalidate the February 10, 2025 Judgment, which it said can be upturned by only the Supreme Court.

It also warned the public against being misled by what it called “deliberate misinterpretation” of recent court rulings by the government of Governor Ademola Adeleke and his PDP allies regarding the ongoing local government administration crisis in the state.

In a statement by Chief Adegoke Ogunsola, State Legal Adviser of the APC, the party emphasized that the Court of Appeal’s judgment of June 13, 2025, did not overturn the court’s earlier decision of February 10, 2025, which had reinstated APC-elected local government chairmen and councillors.

According to the APC, the jubilant reaction of the PDP and Governor Adeleke over the June 13 judgment was misplaced and aimed at inciting public confusion.

“Only the Supreme Court has the authority to invalidate the Court of Appeal judgment of February 10, 2025. The PDP is intentionally twisting the outcome of the June 13 ruling to sow confusion and mislead security agencies,” the statement read.

Ogunsola explained that the June 13 decision simply refused to relist an appeal previously dismissed on January 13, 2025, on procedural grounds, and that the Court of Appeal rightly held that it could not reopen a case it had already conclusively decided in Appeal No. CA/AK/270/2022.

The statement further outlined that in the February 10, 2025 ruling, the Court of Appeal allowed APC’s appeal and nullified the earlier Federal High Court judgment which had sacked the APC-elected local government officials from the October 15, 2022 elections.

Among the granted reliefs by the Court of Appeal were:

Setting aside the Federal High Court’s rulings of September 15 and November 25, 2022

Dismissing the PDP’s originating suit (Suit No: FHC/OS/CS/94/2022)

Restoring the APC-elected chairmen and councillors to office

“These rulings remain valid, binding, and unchallenged by any higher court,” Ogunsola noted. “Therefore, any suggestion that the June 13 judgment overturned the February 10 ruling is legally unfounded.”

He cited the lead judgment delivered by Justice Obiorah, JCA, who made it clear that the Court of Appeal could not entertain an attempt to revisit matters already conclusively determined in the sister appeal decided in February.

“The sudden attempt to resurrect an appeal dismissed on January 13, 2025—based on identical facts and a judgment already delivered by the same court—amounts to a backdoor effort to confuse the judiciary,” Ogunsola quoted.

The APC condemned the attempt by Governor Adeleke and his allies to use the court’s refusal to relist the abandoned appeal as justification to declare the earlier judgment invalid. The party also criticized the PDP for referencing a “purported” local government election allegedly held on February 22, 2025, which they claimed was never properly brought before the court and did not exist as at the time of the motion for relisting filed on January 23, 2025.

The APC accused the Adeleke administration of attempting to hijack local government authority through misinformation and political intimidation. It called on national security agencies and judicial authorities to reject what it called “a plot to undermine democracy in Osun.”

> “We urge the Attorney General of the Federation, the Inspector General of Police, the Director of the Department of State Services, and other security agencies to hold the Adeleke-led government accountable and prevent any unconstitutional seizure of democratically elected local councils,” the statement urged.

The party also warned of the consequences of renewed political violence, referencing the tragic events of February 17, 2025, where it alleged that Hon. Remi Abass and six other APC members were assassinated during a politically motivated attack.

“Let it be known that any further attempt to unleash political mayhem will be lawfully resisted. The APC will not tolerate another round of violence or intimidation from this lawless government,” the party concluded.
