The Supreme Court on Tuesday reserved judgment in a suit filed by the Osun State Government seeking to restrain the Attorney General of the Federation (AGF) from releasing withheld Local Government funds to council chairmen elected on the platform of the All Progressives Congress (APC).
A seven-member panel of Justices, led by Justice Uwani Aba’aji, reserved judgment after hearing submissions from the legal representatives of both parties — Musbau Adetunbi, SAN, for the Osun State Government, and Chief Akin Olujimi, SAN, for the AGF.
Justice Aba’aji stated that the date for the delivery of judgment in the suit, marked SC/CV/773/2025, would be communicated to the parties in due course.
In the suit, the Osun State Attorney General is seeking an order of the apex court to compel the AGF to release statutory allocations to chairmen and councillors duly elected for the 30 Local Government Areas in the state — not to those whose elections had been invalidated.
The Osun Government is contesting a letter issued by the AGF, which recognized the APC-elected local government officials, despite ongoing legal proceedings. The state argues that the AGF acted improperly by intervening in a matter still before courts of competent jurisdiction.
The plaintiff further noted that the elections which brought the APC officials into office had already been nullified by a Federal High Court, a decision that was subsequently upheld by the Court of Appeal in Abuja.
Presenting the state’s case, Adetunbi, SAN, urged the Supreme Court to uphold the arguments of the Osun Government and grant all the reliefs sought.
In response, Chief Akin Olujimi, SAN, representing the AGF, argued for a dismissal of the suit, urging the apex court to reject the plaintiff’s claims on various legal grounds.
